OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees by exposing employees to struck-by and/or caught-between hazards:   On or about 12/21/2021, at the establishment located at 11840 NW 41st St, Coral Springs, FL 33065, employees were exposed to struck-by and caught-between hazards while working in the proximity of moving vehicles and powered industrial trucks.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about 12/21/2021, at the establishment located at 11840 NW 41st St, Coral Springs, FL 33065, employees were exposed to a struck-by hazard due to the operator of a powered industrial truck (i.e. Toyota, Model # 8FBCU25 and Serial #65824) not trained in the safe operation of the forklift.
