29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a. On the 6:12 pitch roof of a 2-story single family residence under construction, located at 356 Hallowes Cove, Saint Johns, FL: On or about 12/22/2021, the employer exposed employees to eye hazards from flying projectile nails from pneumatic nailers and other flying debris, in that eye protection was not used by the operators of the pneumatic nailers.  b. On the property ground of the 2-story single family residence under construction, located at 356 Hallowes Cove, Saint Johns, FL: On or about 12/22/2021, the employer exposed an employee to eye hazards from flying debris, in that eye protection was not used by the operator of the circular saw.

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:  a. On the 6:12 pitch roof of the single family residence under construction, located at 356 Hallowes Cove, Saint Johns, FL: On or about 12/22/2021, the employer exposed the lead framer and another employee to a fall hazard of 11-foot 10-inch to the ground, in that fall protection was not utilized by employees while attaching roof sheathing.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.  On the back side of the 2-story single family residence under construction, located at 356 Hallowes Cove, Saint Johns, FL: On or about 12/22/2021, the employer exposed employees to an 11-foot 10-inch fall hazard, in that the upper single 12-foot section of a 2-section 24-foot portable fiberglass extension ladder was used and did not extend at least 3 feet above the landing surface while employees gained access to and from the roof.
