29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. On or about January 4, 2022, near the intersection of Foley Road and Crosby-Huffman Road in Crosby, TX, an employee was exposed to struck-by and crushed-by hazards when measuring a pipe in an excavation exceeding a depth of 5 feet with a benching system that did not meet the allowable configurations.
