29 CFR  1926.304(d):Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  New town home construction located on Lots #35-40 Stage Coach Bend, Smyrna, GA 30080, Front side of unit #40: On or about 01/11/2022, the employer exposed employees to severe laceration and/or amputation hazards while operating a Makita 7-1/4-inch circular saw, in that the guard was made inoperable using a wood shim which prevented the lower guard from retracting after a cut was made while cutting the Dens-Glass fire rated sheathing.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    New town home construction located on Lots #35-40 Stage Coach Bend, Smyrna, GA 30080, Third level of unit #40: On or about 01/11/2022, the employer exposed employees to fall hazards of approximately 22-feet, 4-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing and sheathing activities on the third level.
