29 CFR  1910.38(c)(2): The emergency action plan did not include procedures for emergency evacuation, including type of evacuation and exit route assignments:   On or about January 05, 2022, contract employees engaged in installing sprinklers and commissioning a new firewater system activities in the warehouse were exposed to fire, chemical inhalation hazards in case of emergency or chemical release in that there was an evacuation event deficiencies, an egress route mechanism did not operate as designed, the egress route turnstile was malfunction. The emergency action plan did not include procedures for emergency evacuation for contractors to be aware of all exit options. The current emergency action plan did not include descriptions, procedures, and signage explaining, showing additional evacuation locations in the event of chained, shut, blocked exits, or egress route turnstile malfunction for contractors to follow to exit the plant in a safe and ordered manner.

29 CFR  1910.119(f)(1): The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the process safety information addressing at least the elements listed in 1910.119(f)(1)(i)(A)-1910.119(f)(1)(iv):  On or about January 05, 2022, KOCH and contract employees engaged in supporting, contracting, operating, inspecting, testing, and maintaining activities at the covered process equipment throughout the plant were exposed to potential release of ammonia which results in asphyxiation, explosion and flash fire leading to death and injury to persons in and near the facility in that the employer failed to develop and implement clear instructions for safely conducting activities involved in each covered process consistent with the process safety information pertaining to the equipment.  e) The Purge Gas Scrubber Startup, SUP KS11 01 18 007 Standard Operating Procedure (SOP), Revision #3.0 was deficient in that the Process Piping & Instrumentation Diagrams (P&IDs) was referenced without the ID or control number. Procedures xxxxx through xxxxx (Includes Hazmat Inventory Control), what procedure?  The SOP procedural steps instruct employees to verify valve conditions, to open, close, or shut valves during operations, and emergency situations. Because of this reason, the P&ID must be identified in each of the SOP to be able to quickly reference, and to avoid confusion. Employees and contractors must immediately know what valves to open and close, which P&ID to review, to identity, to work with in case of emergency.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   Employees engaged in machining/maintenance activities at the following pieces of equipment located in the Maintenance Shop were exposed to struck-by and amputation hazards in that machine guarding was not provided and utilized. Employees were not provided protection from flying chips and debris:  a) Birmingham YCL-1236GH Horizontal Lathe/Mill machine, the rotating drill chuck was not guarded. b) Birmingham YCL-1660 Horizontal Lathe/Mill machine, the rotating drill chuck was not guarded. c) Bridgeport Drill Press machine, the rotating drill chuck was not guarded.

29 CFR  1910.215(b)(9):The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:  Employees engaged in machining/maintenance activities at the Baldor Bench Grinder #7300, located in the Maintenance Shop were exposed to struck-by hazards in that the distance from the abrasive wheel to the adjustable tongue guard was found to be approximately one-half inch away from the grinding wheel.
