On or about January 18, 2022, and times prior, in the remote field, employees operating the John Deere tractor equipped with ROPS to plant trees did not have a seatbelt, exposing employees to a struck-by and fall hazard.

29 CFR 1928.51(b)(2)(i)(B): Where ROPS were required by this section, the employer did not ensure that each employee tightened the seatbelt sufficiently to confine the employee to the protected area provided by the ROPS: a. On or about January 18, 2022, and times prior, in the remote field, employees operating the Kubota tractor equipped with ROPS used to plant trees did not use the seatbelt, exposing employees to a struck-by and fall hazard. b. On or about January 18, 2022, and times prior, in the remote field, the supervisor operating the John Deere 7130 Premium tractor equipped with CAB used to plant trees did not use the seatbelt, exposing employees to a struck-by and fall hazard.
