29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) The Palace Rehabilitation Center located at 315 W Mill Rd, Maple Shade, NJ 08052:  On or about 12/30/21 through 1/18/22 the employer did not provide a medical evaluation before a temporary employee wore a respirator while providing care to known and suspected COVID-19 positive patients.  The employer required the employee to wear a respirator while providing care to suspected and confirmed positive COVID-19 patients.

29 CFR  1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):   a) The Palace Rehabilitation Center located at 315 W Mill Rd, Maple Shade, NJ 08052:  On or about 12/30/21 through 1/18/22, the employer required an employee to wear a respirator while providing care to suspected and confirmed positive COVID-19 patients.  The employee failed the fit test, but was still required to wear the respirator.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:   a) The Palace Rehabilitation Center located at 315 W Mill Rd, Maple Shade, NJ 08052:  On or about 12/30/21 through 1/18/22 the employer did not provide a fit test to all employees required to wear respirators. The employer required employees to wear respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 patients.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   a) The Palace Rehabilitation and Care Center located at  315 W Mill Road, Maple Shade, NJ: On or about 12/30/21 to 1/20/2022,  the employer permitted and required an employee with facial hair to wear a respirator  to protect against the SARS-CoV-2 virus while providing care to suspected  and positive COVID-19 residents.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
