29 CFR  1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  On or about January18, 2022, at the jobsite employees were observed working from the second level of a 2-tier scaffold that did not have guardrails installed and were not in use of fall protection.  This exposed the employees to a fall hazard greater than ten (10) feet to the ground below.

29 CFR  1926.451(c)(2)(i):  Footings were not level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement:  On or about January 18, 2022, at the jobsite employees were working from a 2-tier scaffolding and the scaffold baseplates were not secured to the mudsills to prevent displacement.  The employees were exposed to fall hazards.
