29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Cleaning Contractors, Inc. at the worksite located at 913 Bowman Street in Mansfield, Ohio: On or about April 19, 2022, the employer did not provide medical evaluations to employees who were required to wear respirators. Employees entering Baghouse #8 and #9 to vacuum K061 dust from the floor and ledges are required to wear, at minimum, a half mask filtering facepiece respirator. Employees wearing a filtering facepiece respirator without a prior medical evaluation are exposed to hazards associated with aggravation of pulmonary issues, such as asthma, emphysema and aggravate claustrophobia.

29 CFR 1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): Cleaning Contractors, Inc. at the worksite located at 913 Bowman Street in Mansfield, Ohio: On or about April 19, 2022, the employer did not fit test those employees who were required to wear tight fitting respirators. Employees entering Baghouse #8 and #9 to vacuum K061 dust from the floor and ledges are required to wear, at minimum, a half mask filtering facepiece respirator (Makrite 9500-N95 or 3M 8210 N95). Employees were exposed to hazards associated with K061 dust such as, but not limited to, irritation to the eyes and skin, nausea, and dermatitis.

29 CFR 1910.134(g)(1)(i)(A):Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: CCI Midwest, LLC doing business as Cleaning Contractors, Inc. at the worksite located at 913 Bowman Street in Mansfield, Ohio: On or about April 19, 2022, the employer did not ensure employees who were required to wear tight fitting filtering facepiece respirators were clean shaven. Employees entering Baghouse #8 and #9 to vacuum K061 dust from the floor and ledges are required to wear, at minimum, a half mask filtering facepiece respirator (Makrite 9500-N95 or 3M 8210 N95). Employees were exposed to hazards associated with K061 dust such as, but not limited to, irritation to the eyes and skin, nausea, and dermatitis due to facial hair interfering with the sealing surface between the facepiece and face.
