29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. a) COVID Unit 2S: On or about 1/15/22, the employer did not record on the 2022 OSHA-300 log a work-related recordable illness when a certified nursing assistant provided care to residents infected with SARS-CoV-2 (the virus which causes the illness COVID-19) and then tested positive for SARS-CoV-2 and lost work time. b) Unit 7S: On or about 1/19/22, the employer did not record on the 2022 OSHA-300 log a work-related recordable illness when a certified nursing assistant provided care to residents infected with SARS-CoV-2 (the virus which causes the illness COVID-19) and then tested positive for SARS-CoV-2 and lost work time. c) COVID Unit 2S: On or about 1/21/22, the employer did not record on the 2022 OSHA-300 log a work-related recordable illness when a certified nursing assistant provided care to residents infected with SARS-CoV-2 (the virus which causes the illness COVID-19) and then tested positive for SARS-CoV-2 and lost work time. d) Unit 7S and Unit 7N: On or about 1/24/22, the employer did not record on the 2022 OSHA-300 log a work-related recordable illness when a certified nursing assistant provided care to residents infected with SARS-CoV-2 (the virus which causes the illness COVID-19) and then tested positive for SARS-CoV-2 and lost work time. The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00.

29 CFR 1910.134(m)(1): Records of medical evaluations required by 29 CFR 1910.134 were not retained and made available in accordance with 1910.1020: a) Entire Facility: The employer did not maintain respirator medical evaluations for certified nurse assistants who were required to wear respiratory protection when providing care to residents who were suspected and confirmed to be positive for SARS-CoV-2 (the virus which causes COVID-19 illness); on or about 1/21/22. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
