1910.132(d)(2) The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. On or about January 11, 2022, an employee of the Employer who was collecting trash in the grassy highway median was fatally injured when struck by a third party's vehicle that left the traveled roadway. The Employer failed to produce a written certification of hazard assessment showing that the required workplace hazard assessment had been performed for the work at issue.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident. On January 11, 2022, an employee died as a result of being struck by a moving vehicle while working within the grassy median adjacent to a public roadway. The fatality was not reported to the Austin Area Office of the Occupational Safety and Health Administration within eight (8) hours.
