29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access:  On or about 1/31/2022 at the jobsite on the front side of the structure.  Employees were observed climbing the  frames of the scaffold to access and egress from the second platform level, measured to be approximately 13 1/2 feet above the ground, a practice that exposed them to the hazard of falling from the scaffold to the ground.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.   On or about 1/31/2022 at the jobsite on the front side of the structure.  Employees were observed working from the unguarded or partially guarded second platform level, measured to be approximately 13 1/2 feet above the ground, a practice that exposed them to the hazard of falling from the scaffold to the ground.  The two ends were not guarded, three of the four platforms were missing midrails and the fourth platform was missing the top rail.
