At the facility located at 508 North Mill Street, Weyauwega, WI 54983, the employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation, exposing employees to struck-by hazards in the following instances:  a) On or about February 8, 2022, three employees operated a powered pallet jack without completing training and an evaluation; b) On or about January 25, 2022, one employee operated a forklift (Yale Forklift Model ERP040VTN36TE082, SN G807N03436K) without completing training and an evaluation.

29 CFR  1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  a) On or about February 8, 2022, at the facility located at 508 North Mill Street, Weyauwega, WI 54983, the employer did not ensure that powered industrial trucks were examined before being placed in service. A powered pallet jack used by an employee was not examined for defects prior to being placed into service, exposing employees to struck-by hazards.
