29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation.  On or about February 9, 2022, employees were cutting asphalt using a ECHO cut-off saw Model CSG-7410 without the use of eye protection, exposing the employees to the hazard of being struck-by flying asphalt particles.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On or about February 9, 2022, employees were dry cutting an asphalt patch using a ECHO cut-off saw Model CSG-7410 without the use of respiratory protection, engineering controls, or work practices.  The activities produced dust containing respirable crystalline silica, exposing the employees to inhalation hazards.

29 CFR  1926.1153(f)(1): The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods were feasible.  On or about February 9, 2022, employees were dry sweeping an asphalt patch using an ECHO backpack blower, Model PB-580T, and a broom. The activities produced dust containing respirable crystalline silica, exposing the employees to inhalation hazards.

29 CFR  1926.1153(i)(2)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of at least the information contained in paragraphs (i)(2)(i)(A)-(i)(2)(i)(F) of this standard.  On or about February 9, 2022, employees were dry cutting an asphalt patch using an ECHO cut-off saw Model CSG-7410.  The activities produced dust containing respirable crystalline silica. Employees were not trained in the health hazards and work measures associated with respirable crystalline silica, exposing the employees to inhalation hazards.
