29 CFR  1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a)  The employer failed to provide certification of abatement for two citations issued on March 25, 2022, with citation 1-1 related to providing required safety glasses and citation 1-2 related to providing required ladder safety training.  b)  The employer failed to provide certification and documentation of abatement for three citations issued on  March 25, 2022, with citation 2-1a related to initiating and maintaining required safety programs for fall from elevation hazards and struck-by hazards, citation 2-1b related to providing required employee fall protection safety training, and citation 2-2 related to providing required fall protection safety equipment.

On or about February 8, 2022, at a construction site located at 2427 Riddle Court in De Pere, Wisconsin, employees were exposed to potential struck-by hazards when operating pneumatic nail guns without utilizing safety glasses.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.   On or about February 8, 2022, at a construction site located at 2427 Riddle Court in De Pere, Wisconsin, the employer did not initiate a ladder safety program and did not provide required ladder safety training to employees who were exposed to a fall from elevation hazard when utilizing an extension ladder to access/egress a roof surface.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On or about February 8, 2022, at a construction site located at 2427 Riddle Court in De Pere, Wisconsin, employees were exposed to fall hazards while working on a roof at 10.5 feet above surface level without utilizing fall protection equipment.  The Vazquez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1350649, citation number 1, item number 1 and was affirmed as a final order on November 6, 2018, with respect to a workplace located at 2533 Wilder Ct.; Green Bay, WI  54311.  The Vazquez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1348189, citation number 2, item number 1 and was affirmed as a final order on November 6, 2018, with respect to a workplace located at Tullip Trail; Appleton, WI  54911. 29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On or about February 8, 2022, at a construction site located at 2427 Riddle Court in De Pere, Wisconsin, employees were exposed to fall hazards while using an extension ladder to access/egress a roof surface at 10.5 feet above surface level without the side rails extended three feet above the roof surface.  Side rails were extended eight inches above the roof surface.  The Vazquez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1348189, citation number 1, item number 2 and was affirmed as a final order on November 6, 2018, with respect to a workplace located at Tullip Trail; Appleton, WI  54911.
