29 CFR  1926.451(g)(1)(i):Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold shall be protected by a personal fall arrest system;  a. On or about February 9, 2022 at 116-18 Farmers Boulevard, St. Albans, NY, 11412.  Employees working on ladder jack scaffold approximately 23 feet above the lower level installing roofing shingles were not protected from falling to the lower level.   ABATEMENT CERTIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR  1926.454(a)(1):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  a. On or about February 9, 2022 at 116-18 Farmers Boulevard, St. Albans, NY, 11412.  Employees working on ladder jack scaffolds were not trained on the use of fall protection. The working level was approximately 23 feet from the lower level.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
