29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. (a) Facility: The use of respiratory protection, N95 filtering facepiece respirators, was required for Resident Assistants who provided direct care, including assisting in transfers from a wheelchair and dressing, to COVID-19 positive residents. The employer did not ensure that fit testing was conducted prior to requiring the use of N95 filtering facepiece respirators, on or about January 8, 2022 to January 22, 2022 .

29 CFR 1910.134(k)(1): The employer did not provide effective training to employees who were required to use respirators: (a) Facility: The use of respiratory protection, N95 filtering facepiece respirators, was required for Resident Assistants who provided direct care, including assisting in transfers to and from a wheelchair and dressing, to COVID-19 positive residents. The employer did not ensure that training was conducted prior to requiring the use of N95 filtering facepiece respirators, and did not ensure the employees understood how improper fit, improper usage and failure to conduct seal checks could compromise the protective effect of the respiratory protection, on or about January 8, 2022 to January 22, 2022 .
