Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer could demonstrate that a wider space was necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform).  On or about 2/15/2022, employees working for Julian Arellano were installing masonry material on the wall of a commercial building located at 215 S. Kingshighway in Cape Girardeau, MO. Juliann Arellano, the owner, and five employees were working on scaffolding, which was not fully planked. The platform units were not installed so that the space between adjacent units was no more than 1 inch wide.

When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used. Cross braces were used as a means of access.  On or about 2/15/2022, employees from Julian Arellano were installing masonry materials on the wall of a commercial building located at 215 S. Kingshighway in Cape Girardeau, MO. Juliann Arellano, the owner, and five employees did not use a ladder to access the scaffolding platform, which was approximately 15 feet above the ground.  The owner and the employees were observed accessing the scaffolding platform by climbing up and down the scaffolding.

Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  On or about 2/15/2022, employees working for Julian Arellano were installing masonry materials on the wall of a commercial building located at 215 S. Kingshighway in Cape Girardeau, MO. Juliann Arellano, the owner, and five employees were working from a scaffold platform approximately 15 feet above the ground without utilizing fall protection.
