29 CFR 1910.147(c)(6)(i):The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed. a. On or about and prior to February 22, 2022, the employer failed to conduct the required annual inspection of the energy control procedures for the facility. Machining department employees regularly performed required duties covered by this part that include tool changes and cleaning of milling machines. During covered activities, employees work in the danger zone of milling machines with exposure to caught-in, struck-by and implalement hazards associated with the potentila unexpected energization of tooling, tooling apparatus and tool carousel movement.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a. On or about and prior to February 22, 2022, the employer failed to apply energy control procedures for covered activities performed on Milling Machines, including the Kitamura MyCenter HX800iL (HM-21), the OKK MCH 600 (HM-22), the OKK MCV 820 (VM-11), the YAMA Seiki machining center (VM-12) and the Mitsubishi MVR 30 (FM-51). The employer did not assure that the following elements and actions were done in the required sequence, in that operators did not have knowledge in the methods or means to control milling machine hazardous energy sources, that milling machines were shutdown or turned off using compliant machine specific procedures, that milling machines were not isolated by the use of energy isolating devices, such as electrical disconnects, that lockout devices (or tagout devices) were not affixed to energy isolating devices to assure the devices are in an "off" or "safe" position and that verification of isolation is accomplished prior to the performance of work covered by this part. Machine operators performed covered activities, including tool changes and cleaning, without the performance of the actions required by 29 CFR 1910.147(d)(1)(-(6). During covered activities, machine operators have exposure to potential struck-by and caught-in hazards associated with milling machine tooling apparatus and tools.

On or about February 22, 2022, machine operators and the assistant manager working in the Machining department had not received lockout/tagout (control of hazardous energy) training as authorized employees. Machining department employees performed required duties that are covered by this part on a regular basis . During tool changes and cleaning, Machining department employees have have potential exposure to the unexepected energization of milling machines tools and tool apparatus which involve caught-in, struck-by and impalement hazards.

29 CFR 1910.303(g)(2): Guarding of live parts. 29 CFR 1910.303(g)(2)(ii): In locations where electric equipment is likely to be exposed to physical damage, enclosures or guards shall be so arranged and of such strength as to prevent such damage. a. On or about and prior to February 22, 2022, the electrical power supply cord for a lamp (located and mounted inside the operating zone of the OKK MCV 820 milling machine) had a splice that was not protected from damage. The splice was not mounted inside an electrical junction box and was simply wrapped in electrical tape. Due to this condition, the machine operator is exposed to an electric contact/shock hazard when working in the area.

On or about February 22, 2022, the employer failed to include health hazards associated with spray painting for the painter. Hazardous chemicals used in spray painting operations include Sher Kem high gloss metal finishing enamel and includes the hazardous ingredients toluene, titanium dioxide and light aliphatic hydrocarbons. Health hazard statements associated with this chemical include H335 - May cause respiratory irritation, H336 - May cause drowsiness or dizziness and H351 - suspected of causing cancer.
