29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a) On or about February 15, 2022, and at times prior,  the employer, Groundworks Colorado, LLC DBA: Complete Basement Systems, LLC, did not ensure employees had a safe means of egress while conducting foundation repairs in a trench approximately 9 feet in depth.

(a) On or about February 15, 2022, and at times prior, the employer, Groundworks Colorado, LLC DBA: Complete Basement Systems, LLC, did not ensure each employee in an excavation was protected from cave-in hazards while conducting foundation repairs. The employees were working in a trench with vertical walls of 9 feet in depth and 2 feet in width.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:   (a) On or about February 15, 2022, and at times prior, the employer, Groundworks Colorado, LLC DBA, Complete Basement Systems, LLC,  exposed  employees to cave-in hazards while working in an unprotected trench that had not been evaluated for hazards by a competent person on site. The trench was approximately 9 feet deep with vertical walls and required a protective system and a safe means of egress.
