29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Crossings at Pinebrook Apartments - 351 Azalea Rd (Building B/North Wall): On or about February 23, 2022, and at times prior; the controlling employer, KDF Enterprises, LLC failed to ensure employees of the sub-contractor, Roofing and Construction, LLC were wearing hard hats or other head protection while performing masonry wall construction activities beneath an elevated JLG 450AJ telescopic boom aerial lift basket; exposing employees to struck-by hazards from falling materials (bricks), and tools.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: a) Crossings at Pinebrook Apartments - 351 Azalea Rd (Building B/North Wall): On or about February 23, 2022, and at times prior; the controlling employer, KDF Enterprises, LLC failed to ensure employees of the sub-contractor, Roofing and Construction, LLC were using a full body harness and tied off while working from an elevated JLG 450AJ telescopic boom aerial lift basket; exposing employees to fall hazards of up to twenty-five (25) feet to the concrete ground below.
