29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) On or about February 23, 2022 and times prior; residential construction site at 330 East Sunset Ave, Pensacola, FL: The employer failed to ensure employees conducting work activities from the third level scaffold platform were protected from falls in that the platform level was not fully planked and missing a mid rail.  b) On or about February 23, 2022 and times prior; residential construction site at 330 East Sunset Ave, Pensacola, FL: The employer failed to ensure employees using the second level platform to gain access on/off the third level platform were protected from falls.  The second level platform (1 foot 8 inches below the third level platform) was not fully planked and had no guardrails installed which exposed employees to fall hazards.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a) On or about February 23, 2022 and times prior; residential construction site at 330 East Sunset Ave, Pensacola, FL: The employer failed to ensure employees conducting work activities from a fabricated tube scaffold had proper access on/off scaffold platforms in that employees climbed the end frames and cross bracing  due to no adequate ladder being set-up, exposing them to fall hazards of various heights.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   a) On or about February 23, 2022 and times prior; residential construction site at 330 East Sunset Ave, Pensacola, FL: The employer failed to ensure an employee on the first roof level was protected from falls to the ground.  b) On or about February 23, 2022 and times prior; residential construction site at 330 East Sunset Ave, Pensacola, FL: The employer failed to an employee working from the porch was protected from falls to the ground.
