29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)  Jobsite:  On or about February 24, 2022, the guard to the Wyrks Tool & Machine Ltd. chop saw blade did not enclose the blade when the wood was being cut.  At the time of the incident the employee would activate the foot pedal to the machine and the existing guard would come down to the thickness of the wood being cut but not to the top of the table of the chop saw.  The height of the wood being cut was about 1.5 inches and the blade guard was about 2 inches wide.  This condition could allow the employees hand to go under the blade guard and come in contact with the rotating blade of the chop saw.  Also, the saw blade guard in normal operation was about 8-9 inches above the saw's table where the wood to be cut by the saw were placed.  Once the foot pedal is activated the guard comes down and holds the wood in place and the saw comes up from beneath the table and cuts the wood.   The employee had his hand on the table and went to move his leg/foot from away from the foot pedal guard, as he was done using the machine, and he accidently hit the foot pedal guard and the blade guard immediately traveled down and pinned his hand to the top of the table, then the circular saw blade came up from beneath the table and amputated the employees left thumb and left index finger.     In addition, the steel foot pedal that activated the Wyrks Tool & Machine Ltd chop saw was smooth.  This condition could help contribute to an accidental activation of the chop saw.
