29 CFR 1915.77(c): When employees were working aloft, or elsewhere at elevations more than 5 feet above a solid surface, either scaffolds or a sloping ladder, meeting the requirements of Subpart E- Scaffolds, Ladders, and Other Working Surfaces, were not provided to afford safe footing, nor was the employee protected by safety belts and lifelines meeting the requirements of �� 1915.159 and 1915.160: a. On or about February 28, 2022, an employee was working aloft at an elevation of approximately 11 feet above the lower surface, during which time the employer did not ensure that fall protection was provided and used by the employee; therefore, exposing the employee to a fall hazard.

29 CFR 1915.82(c)(1): Where the only means of illumination on a vessel or vessel section was from lighting sources not part of the vessel or vessel section, the employer did not provide portable or emergency lights for the safe movement of each employee: a. On or about February 28, 2022, an employee was working aloft at an elevation of approximately 11 feet above the lower surface, during which time the employer did not ensure that portable lighting was provided and used by the employee and wherein the working area was completely darkened/ contained little or no lighting at all; therefore, exposing the employee to a fall hazard.
