29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. On or about March 1, 2022 and at time thereafter, the employer did not ensure that surfaces including floors and elevated non-floor surfaces in the pallet manufacturing portion of the building containing equipment such as, but not limited to the Baker Band Resaw and Baker Cut-off saw were maintained in a clean and orderly condition. Saw dust and wood debris was allowed to accumulate on floors and building surfaces exposing employees to fire hazards. To abate this hazard, minimally, the employer must implement a housekeeping program to ensure saw dust and wood debris is removed on a regular basis so as to not pose a fire hazard.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about April 6, 2022, the employer did not implement a continuing, effective hearing conservation program which includes noise monitoring, employee notification, audiometric testing, training, information, and recordkeeping. a) An employee operating the Baker Band Resaw, Baker Cut-off saw, and a pneumatic nail gun was exposed to noise at an 8-hour time weighted average of 90.8 dBA, as measured over 454 minutes of sampling . b) An employee operating the Baker Band Resaw, Baker Cut-off saw, and a pneumatic nail gun was exposed to noise at an 8-hour time weighted average of 88.7 dBA, as measured over 451 minutes of sampling .
