29 CFR  1910.178(l)(4)(ii):  Refresher training in relevant topics shall be provided to the operator when:  29 CFR  1910.178(l)(4)(ii)(B):  The operator has been involved in an accident or near-miss incident;  a.  On or about December 15, 2021 the employer did not provide refresher training for the forklift operator who had been involved in an accident or near-miss incident.  The operator struck the pallets at the receiving area of the worksite location and exposed two employees to a near-miss/struck-by hazard as a result.  b.  On or about March 01, 2022, the employer did not provide refresher training for the forklift operator who had been involved in an accident or near-miss incident.  The operator struck the interior wall of the truck trailer and exposed an employee to a near-miss/struck-by hazard as a result.
