29 CFR  1926.602(d):The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.  EACH 1910 STANDARD USED MUST INCLUDE "AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)" at the end of the SAVE.  29 CFR  1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.  On or about March 07, 2021, and at times prior thereto, an employee was operating a SkyTrak with a site-made wooden trash box on the forks without receiving training from the employer to operate it, exposing employees to fall and struck-by hazards.

29 CFR  1926.451(c)(2)(v):Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied.   On or about March 07, 2022, and at times prior thereto, an employee was working from a site-made trash box that was not secured to the forks and elevated to heights of 18 feet and higher, exposing employees to fall hazards.
