29 CFR  1910.1053(j)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200):  a) On and before 3/11/2022, at store, for employees drilling and grinding ceramic light fixtures containing chemicals such as, but not limited to, silica.  The employer had not developed and implemented a hazard communication program that included information regarding the hazards of respirable crystalline silica.

29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  a) On and before 3/11/2022, at store, for employees drilling and grinding ceramic light fixtures containing chemicals such as, but not limited to, silica.  Employees are required to don a KN95 mask.  The employer did not select the appropriate respirator for exposure to silica.
