29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New townhome construction located on Lots #36 - #40 Castleberry Avenue, Marietta, GA 30068, Lot #40 Roof: On or about 03/15/2022, the employer exposed employees to fall hazards of approximately 19-feet, 4-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities on a 6/12 pitched roof. b) New townhome construction located on Lots #36 - #40 Castleberry Avenue, Marietta, GA 30068, Lot #36, Second level top plate: On or about 03/15/2022, the employer exposed employees to fall hazards of approximately 18-feet, 9-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities using the top plate as a walking/working surface.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) New townhome construction located on Lots #36 - #40 Castleberry Avenue, Marietta, GA 30068, Lot #37, Rear second level window rough opening: On or about 03/15/2022, the employer exposed employees to fall hazards of approximately 12-feet, 7-inches to the lower ground level, in that a ladder with side rails extended at least 3-feet past the landing was not provided and the ladder was not secured to the structure to prevent accidental movement during use.
