29 CFR  1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck (and as referenced by note in 1926.602(d):   a) On or about March 16, 2022, employees operated a JLG Gradall material handler along with a home-made scaffold platform,  to support employees.   The employees used the platform as a work surface and a catch platform while performing framing activities.   Note) Abatement certification and documentation are required for this item.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a)  On or about March 16, 2022, employees were exposed to falls of approximately 13 feet to the ground below while performing framing activities on a  scaffold platform supported by a JLG Gradall material handler.  The 16 foot long platform was not attached to the four foot long forks or mast of the Gradall lift.    Note) Certification and documentation of corrective action are required for this item.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use:  a)  On or about March 16, 2022, employees performing framing activities were exposed to falls of approximately 13 feet to the ground below when on a scaffold platform lifted by a JLG Gradall material handler. 29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On or about March 16, 2022, employees were exposed to falls of approximately 16 feet while performing framing activities on a 8 in 12 pitched roof without the use of fall protection.   b)  On or about March 16, 2022, employees were exposed to falls of approximately 10 feet to the ground below while performing framing activities near window openings. The second floor window openings measured 27 inches high.   c) On or about March 16, 2022, employees were exposed to falls of approximately 10 feet while performing framing activities near the second floor balcony, without the use of fall protection.   d) On or about March 16, 2022, employees were exposed to falls of approximately 8 feet while performing framing activities on the second floor near an open sided stairway, without the use of fall protection.
