The scaffolds were not constructed in accordance with the mobile scaffold design and were not installed with guardrail systems and fully planked.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.   a) On or about March 18, 2022, and at times prior, employees were working on the mobile scaffold and exposed to fall hazards of approximately 24 feet high. The scaffold was not fully planked and had gaps of greater than 1 inch.

29 CFR  1926.452(w)(6)(ii): 29 CFR 1926.452(w)(6)(ii): Scaffolds were moved horizontally while employees were on them although the scaffold height to base width ratio was not two to one or less:  a) On or about March 18, 2022, and at times prior, employees were working on the mobile scaffold and exposed to fall hazards of approximately 24 feet high. The mobile scaffold height to base width ratio was approximately four to one (24 feet high by 5 feet wide) and was moved while employees were on them. The scaffold height to base width ratio was not two to one or less.
