29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  On or about March 24, 2022, employees were on the ground cutting wood and assisting cornices workers who were working above on Werner PJ-100 Pump Jack Scaffolds. The employees on the ground were not wearing protective helmets, exposing employees to hazards of being struck by falling materials and tools.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about March 24, 2022, four employees were using saws and pneumatic staple guns to cut wood and secure cornicing to a new home did so without wearing eye protection, exposing the employees to the hazard of being struck in the eye(s) by flying debris or projectiles.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  On or about March 24, 2022, two employees were installing Thermoply cornice while on a Werner PJ-100 Pump Jack Scaffold without the employer providing fall arrest systems or guardrail systems, exposing employees to a fall hazard of approximately 12 feet high.

On or about March 24, 2022, an employee was installing cornice onto a new home using a Werner PJ-100 Pump Jack Scaffold that has not been secured at the bottom using bracing, exposing employees to the hazard of falling from heights.

29 CFR 1926.454(a): The employer did not have each employee who performed work on a scaffold be trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards.  On or about March 24, 2022, two employees were cornicing homes on a Werner PJ-100 Pump Jack Scaffold approximately 12 feet above the ground. Employees were not trained by a qualified person to recognize hazards associated with this type of scaffold, exposing employees to construction hazards including but not limited to falling from heights.
