29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.  Chemical Dip Room: On or about April 6 and June 3, 2022, the foreman who wore a mandatory use half face respirator to protect against chemical vapors was not medically evaluated before performing tasks such as (but not limited to) chemical stripping of metal parts.  Gybenorth Industries LLC was previously cited for a violation of 1910.134(e)(1), which was contained in OSHA inspection number 1460055, citation number 1, item number 2a and was affirmed as a final order on April 6, 2020, with respect to a workplace located at 80 Wampus Lane Suite 13, MILFORD, CT 06460.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function.   Chemical Dip Room: On or about June 3, 2022, the foreman wore a mandatory use half face respirator with significant facial hair growth coming between the sealing surface exposing the worker to chemical vapors while performing tasks such as (but not limited to) chemical stripping of metal parts.  Gybenorth Industries LLC was previously cited for a violation of 1910.134(g)(1)(i)(A), which was contained in OSHA inspection number 1460055, citation number 1, item number 3 and was affirmed as a final order on April 6, 2020, with respect to a workplace located at 80 Wampus Lane Suite 13, MILFORD, CT 06460.
