29 CFR  1910.253(b)(4)(iii):Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.  a) Pinnacle Landscaping, at the jobsite located at 3535 Westerville Rd., Columbus, Ohio 43224: On and/or preceding March 7, 2022, in the mechanic shop, oxygen cylinders were not separated from acetylene fuel-gas cylinders by a minimum distance of 20 feet or by a noncombustible barrier at least 5 feet high having a fire-resistance rating of at least one-half hour, thereby exposing employees to a fire hazard.

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  a) Pinnacle Landscaping, at the jobsite located at 3535 Westerville Rd., Columbus, Ohio 43224: On and/or preceding March 7, 2022, the employer did not develop and implement a written hazard communication program to ensure that employees were provided with required hazard information and training on the hazards associated with the use of the chemicals used in the workplace such as, but not limited to, synthetic oils, lubricants, and aerosols.

Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.  a) Pinnacle Landscaping, at the jobsite located at 3535 Westerville Rd., Columbus, Ohio 43224: On and/or preceding March 7, 2022, the employer did not have or maintain safety data sheets for chemicals such but not limited to, oils, WD-40, O'Reilly's brake parts cleaner, Mac's premium starter fluid, Permatex anti-seize lubricant and Rust-Oleum gloss protective enamel, thereby exposing employees to contact and respiratory hazards.
