OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by, crushing, caught between, and amputation hazards during die set up operations on presses:  A.) American Cap Company- On or about 4/6/22 and times prior thereto, the employer did not develop and implement die setting procedures for the set-up of the hydraulic presses. Presses included, but were not limited to, Toyokoki hyb12530-Press Brake. Employees perform set up and die changes on the presses.   ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR  1910.147(c)(4)(ii):Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  A.) American Cap Company LLC- on or about 4/6/22, and at times prior thereto: The company's lockout/tagout procedures were not specific. Equipment with deficient procedures include, but was not limited to, the Toyokoki hyb12530 press brake.  Deficiencies including, but not limited to specific procedural steps for the placement of the energy isolating devices and specific requirements for testing the equipment to determine and verify the effectiveness of lockout/tagout devices.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1910.212(a)(3)(iii):Special hand tools for placing and removing material(s) was not provided to permit easy handling of material without the operator placing a hand in the danger zone:  A.)American Cap Company LLC, on or about 4/6/22, and at times prior thereto employees fingers/hands were exposed to the point of operation on the Toyokoki HYB-12530 press brake when feeding 7" by 1" parts into the press. The employees were not provided with special tools to keep their hands away from the point of operation when feeding parts and cleaning off the die.    ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
