29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  On or about April 12, 2022, and at times prior to and thereafter,  in the Surgical Intensive Care Unit, a temporary nurse employee was not provided a respirator medical evaluation before she was required to use a N95 respirator.  The employer required  temporary nurse employees to wear N95 respirators, while providing care to patients, to protect against contagious respiratory illnesses.

29 CFR  1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  On or about April 12, 2022, and at times prior and thereafter, in the Surgical Intensive Care Unit, a temporary nurse employee was not provided a respirator fit test for the respirator she wore during her shift.  The employer required temporary nurse employees to wear N95 respirators, while providing care to patients, to protect against contagious respiratory illnesses.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used:   On or about April 12, 2022, and at times prior and thereafter, the employer did not provide an additional fit test when it allowed  ENVO respirators to be used by nursing staff.   In the Surgical Intensive Care Unit, the Interim Director of the unit was not provided a fit test for the ENVO respirator she used to protect against contagious respiratory illnesses.
