The employer required temporary nurse employees to wear N95 respirators, while providing care to patients, to protect against contagious respiratory illnesses.

29 CFR 1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): On or about April 12, 2022, and at times prior and thereafter, in the Surgical Intensive Care Unit, a temporary nurse employee was not provided a respirator fit test for the respirator she wore during her shift. The employer required temporary nurse employees to wear N95 respirators, while providing care to patients, to protect against contagious respiratory illnesses.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used: On or about April 12, 2022, and at times prior and thereafter, the employer did not provide an additional fit test when it allowed ENVO respirators to be used by nursing staff. In the Surgical Intensive Care Unit, the Interim Director of the unit was not provided a fit test for the ENVO respirator she used to protect against contagious respiratory illnesses.

29 CFR 1910.134(m)(4): Written materials required to be retained under 29 CFR 1910.134 were not made available upon request to affected employees and to the Assistant Secretary or designee for examination and copying: On or about May 3, 2022, and at times thereafter, the employer did not provide the fit test records for all regular nurse employees and temporary nurse employees who were required to wear N95 respirators to protect against contagious respiratory illnesses. The Compliance Safety and Health Officer requested these documents on three separate occasions. Instance a) In the Progressive Care Unit, the fit test records for a nurse employee were not provided to the Compliance Safety and Health Officer for examination; Instance b) In the Med/Surge Unit, the fit test records for an agency nurse employee were not provided to the Compliance Safety and Health Officer for examination.
