OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in between hazards. 2100 Dixwell Ave, Hamden, CT: On or about November 22, 2021, at the commercial construction site, an employee cleaning the Weiler Paver Model P385B Product Id Number 1W90P385JMB003439, stepped up on the platform and slipped into the hopper while the machine was on, exposing the employee to caught-in hazards.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: 2100 Dixwell Ave, Hamden, CT: On or about November 22, 2021, at the commercial construction site, employees doing asphalt paving clean out had not been adequately trained by the employer on the safety features and operation of paving equipment and the hazards of paving operations, to include but not limited to turning the machine off while conducting cleaning, exposing employees to caught-in hazards.
