The employer did not ensure that if the correction or repair cannot be made immediately, the hazard is guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired.  a) On  or about April 14, 2022 at 2001 Castaway Island Road, Anchor Bay Marina, Eclectic, Al: The employer failed to take preventive measures to reduce potential hazards associated with slip/trip/falls due to damaged concrete floor inside the boat storage building after identifying damaged areas.  b) On  or about April 14, 2022 at 2001 Castaway Island Road, Anchor Bay Marina, Eclectic, Al: The employer failed to take preventive measures to reduce potential hazards associated with slip/trip/falls due to damaged concrete pad area adjacent to the outside boat storage area after identifying damaged areas.

29 CFR  1910.132(d)(1):The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  a) On  or about April 14, 2022 at 2001 Castaway Island Road, Anchor Bay Marina, Eclectic, Al: The employer failed to perform  a hazard assessment to determine if personal protection equipment was needed for a personal floatation device (PFD) and rescue equipment for employees servicing boats during task such as but not limited to fueling, when placing boats into the water and positioning them at various piers, and retrieving boats out of the water, as employees get in/out of boats and work from the piers.
