29 CFR 1910.134(m)(1): Records of medical evaluations required by 29 CFR 1910.134 were not retained and made available in accordance with 1910.1020:  (a) Trinity Health Mid-Atlantic-Mercy Fitzgerald Hospital located at 1500 Lansdowne Avenue Darby, PA: On or about April 15, 2022, the employer failed to maintain records of medical evaluations for employees required to wear N95 filtering facepiece respirators such as but not limited to 3M Aura 1870 (TC-84A-5726) and Makrite Sekura N95 (TC-84A-7638)  while providing emergency medical assistance to suspected and confirmed positive COVID-19 patients.

29 CFR  1910.134(m)(2)(ii): Fit test records were not retained for respirator users until the next fit test was administered:  (a) Trinity Health Mid-Atlantic-Mercy Fitzgerald Hospital located at 1500 Lansdowne Avenue Darby, PA: On or about April 15, 2022, the employer failed to maintain records of fit testing for those employees required to wear N95 filtering facepiece respirators such as but not limited to 3M Aura 1870 (TC-84A-5726) and Makrite Sekura N95 (TC-84A-7638) while providing emergency medical assistance to suspected and confirmed positive COVID-19 patients.
