29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  On or about April 19, 2022 the employer Jorge Medina Silva DBA Silva Construction, LLC at jobsite located at 4855 Wickford Drive East Sylvania OH 43560, did not have a plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about April 19, 2022 the employer Jorge Medina Silva DBA Silva Construction, LLC at jobsite located at 4855 Wickford Drive East Sylvania OH 43560, did not have a fall protection training program in place to enable each employee to recognize the hazards of falling, and procedures to minimize these hazards. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury or illness.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about April 19, 2022 the employer Jorge Medina Silva DBA Silva Construction, LLC at jobsite located at 4855 Wickford Drive East Sylvania OH 43560, did not ensure that employees were protected from head injury hazards by protective hardhats while working directly below and under a second level roofing construction jobsite. Employees were exposed to potential struck by injuries caused by falling and blowing construction debris, including sheets of plywood roof sheeting material which was blowing off the roof due to high winds.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about April 19, 2022 the employer Jorge Medina Silva DBA Silva Construction, LLC at jobsite located at 4855 Wickford Drive East Sylvania OH 43560, did not ensure employees were protected from falls while conducting residential roofing construction activities on the second and third level of a  multi-family building, while exposed to a fall of approximately 20 feet or greater to the ground below.
