29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas. Location - 11 Carey Avenue, Burlington, MA. On or about April 20, 2022, five employees were exposed from discarded lumber with protruding nails that had not been removed from the work area. This hazard existed on the right side of the house where employees would walk to gain access to the back of the house.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. Location - 11 Carey Avenue, Burlington, MA. On or about April 20, 2022, the following fall hazard instances were observed; Instance A: Five employees were exposed to fall hazards greater than fifteen feet above lower level from multiple window openings. The unprotected windows were located on the second floor. The employer/employees constructed the walls with the window openings in them. Employer had employees placed planking or railing system over the window openings during inspection. Instance B: Five employees were exposed to fall hazards greater than sixteen feet above lower level. The employees were working/walking next to unprotected side/edges while framing. The employees were on the attic deck placing planks down. Instance A: An employee was exposed to fall hazard greater than fourteen feet above lower level from unprotected second floor deck. The employee assisted the owner with securing a plank.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards. Location - 11 Corey Avenue, Burlington, MA. Instance A: On or about April 20, 2022, the employer failed to ensure that two employees exposed to fall hazards were properly trained. The employees were working at heights greater than sixteen feet above lower level without fall protection. Instance B: Owner did not provide fall protection documentation and or other training material showing that he and two of his employees had received fall protection training.

Location - 11 Carey Avenue, Burlington, MA. On or about April 20, 2022. a safe access point was not provided for five employees to access residential house. The break in elevation from ground to first floor was greater than five feet eight inches in height above ground level.

On or about April 20, 2022, five employees were using a WERNER six foot fiberglass stepladder, designed to be used in the open and braced position, ladder was left in the closed position. The employees were using the ladder to access first floor deck.
