29 CFR  1926.501(b)(14): Duty to have fall protection. "Wall openings." Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a) On or about 04/20/2022 an employee while helping other framers by reaching material through a window opening which the inside bottom edge of the wall opening was measure at 23 inches above the walking surface at a new residential structure, was exposed to a fall hazard of at least 19.7 ft. from the ground; while working with no fall protection system in place.

29 CFR  1926.502(d)(15)(i): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows: as part of a complete personal fall arrest system which maintains a safety factor of at least two   a) On or about 04/20/2022, the employer did not ensure that his employees were connected to proper anchor points. The height of the fall hazard was measure at 19.7 ft. from the ground in the frontside of the new residential structure.

29 CFR 1926.503(a)(1): Training Program. The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a)       On or about 04/20/2022 employees have not been trained on fall protection systems and on hazards of falls, while working at heights measured at  19.7 ft. from the ground.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a.) On or about 04/20/2022,  employees were exposed to a 19.7 ft. fall hazard while framing a new residential structure without any means of conventional fall protection system in place.  The employer, ECSA Quality Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1427904, citation number 1, item number 1 and was affirmed as a final order on 12/03/2019, with respect to a workplace located at 5463 Birch View Drive, Mason, OH 45040.
