Employees were working to install two 6" conduits in a trench without cave-in protection. The trench measured approximately 4.0-6.0 feet deep, had nearly vertical walls and was Type B soil next to a previously installed utility line. 29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a) On April 21, 2022; the employer did not ensure the use of an appropriate ladder or other safe means of egress while employees were working to install two 6" conduits in a trench at a depth ranging from 4.0-6.0 feet deep. Employees jumped in as ingress and/or utilized the side and the end of the trench as egress from the work location. Note: Abatement documentation and certification are required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift. a) On April 21, 2022; the employer did not ensure a "competent person" inspected the trench for hazards prior to directing employees to enter the trench. Employees were working to install two 6" conduits in a trench measuring approximately 4.0-6.0 feet deep, with nearly vertical walls and Type B soil without any cave-in protection. This work was occurring directly adjacent and parallel to a previously installed utility line with unstable backfill around it. NOTE - Abatement certification and documentation are required for this item.
