29 CFR 1926.651(h)(1): Employees were working in a excavation in which there was accumulated water, or in a excavation in which water was accumulating and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: On 5/3/2022, employees of Semke Grading LLC were working inside an excavation located at the corner of Mexico Road and McGavock Street, Saint Peters, Missouri. The excavation measuring 11 feet long x 8 feet wide x 7 feet deep had water which was accumulated in the bottom of the excavation measuring less than one inch deep. The presence of the water jeopardized the structural integrity of the soil exposing workers to engulfment and stuck-by hazards.

The spoils pile was not located at least two feet from the edge of the excavation. The weight of the spoils on the trench wall exposed employees to engulfment and struck-by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On 5/3/2022, employees of Semke Grading LLC were working inside an excavation located at the corner of Mexico Road and McGavock Street, Saint Peters, Missouri. The excavation measured approximately 11 feet long x 8 feet wide x 7 feet deep. The slope of the trench walls was steeper than the 1H:1V for a Class B soil, the bench system implemented by employees was not adequate. Employees were exposed to engulfment and struck-by hazards.
