29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: Market District Apartments located at 12695 Birmingham Hwy. Milton, GA 30004, Basement/Parking Deck: On or about 05/04/2022, the employer exposed employee to struck-by hazards while operating a JLG 800AJ Mobile Elevated Work Platform, in that the operator was not provided with head protection while operating the equipment below the concrete slab located directly overhead while loading windows onto the platform.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: Market District Apartments located at 12695 Birmingham Hwy. Milton, GA 30004, Basement/Parking Deck/2nd level: On or about 05/04/2022, the employer exposed employee to ejection/fall hazards while operating a JLG 800AJ Mobile Elevated Work Platform, in that a fall protection system was not provided to the operator who was transporting window units to the upper levels of the structure from the lower level with the basket door propped open to accommodate the large windows.
