29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) On or about February 16, 2022,  through May 11, 2022, Carrington Care, LLC did not provide a medical evaluation to determine employees' ability to use respirators prior to requiring employees to use N95 respirators.  Employees who provided care to COVID-19 suspect or confirmed residents in assisted living, were required to use 3M 8200, 3M Aura, and 3M 8210 N95 respirators.   (b) On or about February 17, 2022, through May 11, 2022, Carrington Care, LLC did not provide a medical evaluation to determine temporary (agency) employees' ability to use respirators prior to requiring temporary employees use N95 respirators.  Temporary employees who provided care to COVID-19 suspect or confirmed residents, in assisted living, were required to use 3M 8200, 3M Aura, and 3M 8210 N95 respirators.

Employees who provided care to COVID-19 suspect or confirmed residents were required to use 3M 8200, 3M Aura, and 3M 8210 N95 respirators.
