29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  (a) Southside of the Building - Employees worked from the two seven-section high fabricated frame scaffolds to paint waterproofing onto the building's brick exterior.  On the sections at the west end of both scaffolds, employees used the scaffold walkways as working platforms while the employee applied the waterproofing to some of the building's surfaces.  All but one west end section on all seven scaffold levels on both scaffolds did not have complete planking or decking in that the five-foot wide sections had decking for only half the width, exposing employees to fall hazards of up to 45.5 feet above grade, on or about May 5, 2022.  No abatement certification or documentation required.

29 CFR  1926.451(g)(1)(v): Each employee on a walkway located within a scaffold was not protected by a guardrail system (with a minimum 200 pound top rail capacity) installed within 9.5 inches (24.1 cm) of and along at least one side of the walkway:   (a) Southside of the Building, Scaffolding Erected to the West of the Building's Rear Entrance Door - Employees worked from the seven-section high fabricated frame scaffold to paint waterproofing onto the building's brick exterior.  Employees used planking installed on the scaffolding's main frames as walkways.  These walkways had no guardrail system on the north side and had an incomplete guardrail system (consisting of only cross bracing at the top rail height) on the south side on the walkways on the eastern two bucks on the third and seventh levels, on the walkways on the far west sections and far east sections on the second, fifth, and sixth levels, and on the walkways on the far west buck and the eastern two bucks on the fourth level, exposing employees to fall hazards from up to 45.5 feet above grade, on or about May 5, 2022.  (b) Southside of the Building, Scaffolding Erected to the East of the Building's Rear Entrance Door - Employees worked from the seven-section high fabricated frame scaffold to paint waterproofing onto the building's brick exterior.  Employees used planking installed on the scaffolding's main frames as walkways.  The walkways did not have a guardrail system along at least one side, exposing employees to  fall hazards from up to 45.5 feet above grade, on or about May 5, 2022.  No abatement certification or documentation required.

29 CFR  1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms:   (a) Southside of the Building, Scaffolding Erected to the West of the Building's Rear Entrance Door - Employees worked from the seven-section high fabricated frame scaffold to paint waterproofing onto the building's brick exterior.  On all levels, the east end of the scaffold had no guardrail system, exposing employees to  fall hazards from up to 45.5 feet above grade, on or about May 5, 2022.  (b) Southside of the Building, Scaffolding Erected to the East of the Building's Rear Entrance Door - Employees worked from the seven-section high fabricated frame scaffold to paint waterproofing onto the building's brick exterior.  On all levels, the east end of the scaffold's side bracket work platforms had no guardrail system.  In addition, on all levels on the scaffold's east end, about two feet of the north side of the side bracket work platforms extended past the building's wall and had no guardrail system, exposing employees to fall hazards from up to 45.5 feet above grade, on or about May 5, 2022.  No abatement certification or documentation required.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:   (a) Southside of the Building, Scaffolding Erected to the East of the Building's Rear Entrance Door - Employees worked from the seven-section high fabricated frame scaffold to paint waterproofing onto the building's brick exterior.  The scaffold had no portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface.  Employees climbed the scaffold end framing, not intended for use as a ladder, exposing employees to fall hazards from up to 45.5 feet above grade, on or about May 5, 2022.  No abatement certification or documentation required.

29 CFR  1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, a grasping device was not provided to assist employees in mounting and dismounting the ladder:   (a) Southside of the Building, Scaffolding Erected to the West of the Building's Rear Entrance Door - Employees worked from the seven-section high fabricated frame scaffold to paint waterproofing onto the building's brick exterior.  The scaffold had a portable ladder on each scaffold level.  These ladders did not have a length that enabled them to extend three feet above the upper landing surface nor was there a grasping device to assist employees in mounting and dismounting each ladder, exposing employees to the hazard of falling 6.5 feet to the scaffold level below, on or about May 5, 2022.  No abatement certification or documentation required.
