29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system.  On or about May 11, 2022, employees of Pina American Contracting LLC were removing shingles from a residential building located at 1212 Russel Boulevard in Saint Louis, Missouri. The employees were working approximately 16 feet above a paved walkway. They were not protected by guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR  1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access.  On or about May 11, 2022, employees of Pina American Contracting LLC were removing shingles from a residential home located at 1212 Russel Boulevard in Saint Louis, Missouri. The employees utilized a ladder to access the roof. The ladder was not extended at least three feet above the upper landing surface or edge of roof.
