If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired  Location - Compactor rooms in basement of  125 E 168th Street, Bronx, NY 10451  a) On or about May 12, 2022 the employer did not ensure the approximately 3.5" drain was covered nor was it guarded while the replacement cover was ordered.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  Location - compactor rooms and basement  a) On or about July 7, 2022 employees were potentially exposed to pest control chemicals including, but not limited to, Vendetta Gel, which contains hazardous chemicals such as abamectin and sodium hypochlorite when cleaning the building. The employer did not develop or implement a written hazard communication program.

29 CFR  1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  Location - entire building and office located at 900 Grand Concourse, Bronx, NY.  a) On or about August 11, 2022, the employer did not maintain in the workplace or office copies of the required safety data sheets for exterminating chemicals, including but not limited to Vandetta Gel,  and did not ensure that they are readily accessible during each work shift to porters when they are in their work area.

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  Location - Building located at 125 E168th St, Bronx, NY   a) On or about May 05, 2022 the employer did not effectively inform and/or train employees who use chemicals such as, but not limited to, bleach and Spray Nine , when cleaning as part of their routine job function.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19.
