29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Employee(s) were exposed to respiratory hazards. On or about May 18, 2022, at Carstar Roe Body Shop, Inc. located at 4715 Roe Parkway Roeland Park, Kansas, the employer did not provide a medical evaluation to determine the employee's ability to use a respirator before requiring the use. The employer required employee to wear air supplied respirator while performing automotive repair and painting activities.

29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Employees are exposed to chemical hazards. Employees engaged in automotive repair activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work. Hazardous chemicals used at the site included but were not limited to 35250 reducer fast, 35291 reducer normal, 3604 metal cleaner, 5415 silicon and tar remover, 92991 hardener fast, and 902 plastic prepcleaner.

Employees performing automotive repair work had not been provided training to recognize, evaluate, and control exposure to hazardous chemicals. Hazardous chemicals used in the facility included but were not limited to 35250 reducer fast, 35291 reducer normal, 3604 metal cleaner, 5415 silicon and tar remover, 92991 hardener fast, and 902 plastic prepcleaner.
